Terms and Conditions for Perch Intel

Welcome to Perch Intel! These Terms and Conditions ("Terms") govern your use of the Perch Intel web-based business intelligence tool and any related services provided by 13th Coffin ("we," "us," or "our").

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

1. Description of Service

Perch Intel is a powerful web-based business intelligence tool designed to help small businesses, marketers, and product managers track changes on competitor websites. The service automatically monitors publicly accessible pages of your competitor's website for changes, such as new product listings, price shifts, and promotional updates. A "page" refers to any unique URL you ask us to monitor.

2. User Accounts

To use Perch Intel, you must create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

3. Subscription Plans and Free Trial

Perch Intel offers several subscription plans with varying features and limits:

  • Scout: Track up to 4 competitors and 8 pages.
  • Watchtower: Track up to 8 competitors and 16 pages.
  • Command Center: Track up to 12 competitors and 24 pages.

All plans come with a 2-week free trial. You do not need a credit card to start the free trial. At the end of the trial, your access will become limited, and your data will be retained for two weeks before permanent deletion unless you upgrade.

4. Payments, Upgrades, and Downgrades

Payments: We use Lemon Squeezy to handle all payments. By providing a payment method, you expressly authorize us and our payment processor to charge you for your chosen subscription plan.

Upgrades and Downgrades: You can upgrade or downgrade your plan at any time through your account settings.

Proration: When you change your subscription plan, the charge for the next billing cycle will be prorated.

  • If you upgrade your plan, you will be charged for the prorated difference in the next billing cycle.
  • If you downgrade, a credit will be issued and applied to your next invoice. Any competitors or pages that exceed the limits of your new plan will be automatically removed.

5. Cancellation and Termination

Cancellation by You: You can cancel your subscription at any time from your account settings. If you cancel a paid plan, you will retain access to your plan's features until the end of your current billing period, after which your account and all associated data will be permanently deleted.

Termination by Us: We may terminate or suspend your account at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms.

6. User Conduct and Responsibilities

Lawful Use: You agree to use Perch Intel only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the service by any third party.

Publicly Accessible Data: Perch Intel is designed to track publicly accessible pages. You may not use the service to track pages that require a login or are on social media platforms like Facebook, Instagram, or LinkedIn. You are solely responsible for ensuring that your use of the service to monitor third-party websites is compliant with those websites' terms of service.

7. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of 13th Coffin and its licensors. Perch Intel and 13th Coffin are trademarks of 13th Coffin.

8. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the service will be uninterrupted, secure, or error-free. We make no warranty regarding the accuracy, timeliness, or completeness of the data collected from competitor websites.

9. Limitation of Liability

In no event shall 13th Coffin, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice before any new terms take effect.

This Privacy Policy outlines how 13th Coffin ("we," "us," or "our") collects, uses, and protects your data when you use Perch Intel. We are committed to protecting your privacy and ensuring the security of your personal information.

1. Data We Collect

We collect the following information to provide and improve our service:

  • Account Information: When you sign up, we collect your email address and store your account settings.
  • User-Provided Content: We store the competitor website URLs and specific page URLs you provide for monitoring.
  • Usage Data: We collect data on how you interact with our service, including the frequency of scans you set and the types of changes you track.

2. How We Use Your Data

Your data is used to:

  • Operate and maintain the Perch Intel service.
  • Provide you with customized alerts and notifications.
  • Send you weekly digest emails and other transactional emails (e.g., trial ending notices).
  • Respond to your support requests and feedback.
  • Monitor and analyze usage to improve the service.

3. Data Sharing and Sub-Processors

We do not sell your personal data. To provide our service, we share information with the following third-party service providers (sub-processors) who process data on our behalf:

  • Hosting: Our application is hosted on Sevalla.
  • Payment Processing: We use Lemon Squeezy to handle payments. We do not store your credit card information.
  • Web Scraping: We use Scrappey.com to perform the scraping of the public web pages you ask us to monitor. Scrappey acts as a data processor on our behalf.
  • Job Queuing: We use Upstash Redis to queue and manage the scraping jobs for the pages you track.
  • Transactional Emails: We use Resend to send you digest emails, account notifications, and other essential service-related communications.
  • Authentication & Data Management: We use Supabase for user authentication and backend database management.

These sub-processors are authorized to use your personal information only as necessary to provide these services to us and are contractually obligated to implement and maintain appropriate data security measures.

4. Analytics

We use Umami for privacy-focused web analytics to understand how our service is used and to improve the user experience. Umami does not collect any personally identifiable information, does not use cookies, and anonymizes all data collected. This means individual users cannot be identified, and you are not tracked across different websites.

5. Data Retention and Deletion

We take your data privacy seriously and provide clear processes for data deletion.

  • Free Trial Expiration: When your free trial ends, your access to the dashboard and tracking features will be disabled. Your tracked data will be stored for two weeks, after which it will be permanently deleted if you do not upgrade to a paid plan.
  • Account Closure (Free Users): You can permanently delete your account and all associated data at any time from the account settings page. This action is irreversible and will permanently delete all your data, including your user profile, tracked competitors and pages, and all historical data from our servers.
  • Subscription Cancellation (Paid Users): If you cancel a paid subscription, you will retain limited access to your plan's features until the end of your current billing period. After this date, your account and all associated data will be permanently deleted from our systems.

6. Your Rights

You have the right to access, update, or delete your personal information at any time through your account dashboard. If you need assistance, you can contact us via the in-app support form.

7. Security

We implement and maintain appropriate administrative, technical, and physical safeguards to protect your personal data from unauthorized access, use, or disclosure.

8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any significant changes by posting the new policy on this page and, where appropriate, through email.
